The UK government has announced a set of four new laws aimed at tackling the increasing threat of artificial intelligence (AI)-generated child sexual abuse material (CSAM). These laws will make the UK the first country to criminalize the possession, creation, and distribution of AI tools used for generating such exploitative content. Offenders could face up to five years in prison.
Additionally, possessing AI-generated manuals that provide guidance on exploiting minors will now be considered a criminal offense, carrying a maximum penalty of three years in prison. These manuals, which detail methods for using AI to manipulate or harm children, pose a significant risk and must be eliminated.
Home Secretary Yvette Cooper emphasized the urgency of these reforms, stating: "Predators who exploit online platforms often escalate their crimes in real life. Our government is taking decisive action to ensure laws keep pace with emerging threats and protect children from harm."
The new measures will also criminalize the operation of websites that enable paedophiles to share CSAM or exchange information on grooming techniques. Individuals running such platforms could face up to 10 years in prison.
In addition, UK Border Force will now have the authority to instruct suspected offenders to unlock their digital devices upon entering the country. This step aims to curb the importation of CSAM, particularly content produced abroad. Depending on the severity of the material discovered, offenders could face up to three years in prison.
AI-generated CSAM has become increasingly sophisticated, with software capable of altering real images by "nudifying" them or swapping faces to create disturbingly realistic content. Experts warn that these images are also being used to blackmail and further exploit victims.
The National Crime Agency (NCA) reports that around 800 individuals are arrested each month in connection with child exploitation cases. Alarmingly, an estimated 840,000 adults in the UK pose a potential risk to minors both online and offline.
While these new measures have been widely welcomed, some experts believe additional steps are necessary. Professor Clare McGlynn, an expert in online abuse laws, stressed the need to ban "nudify" apps and regulate platforms that normalize sexualization of young-looking actors in adult content.
Recent reports from the Internet Watch Foundation (IWF) indicate a staggering 380% increase in CSAM cases, with 245 verified reports in 2024 compared to 51 in 2023. Over a single month, investigators discovered 3,512 AI-generated child exploitation images on just one dark web platform.
Derek Ray-Hill, interim chief executive of the IWF, emphasized the gravity of the situation: "AI-generated CSAM fuels sexual violence against children. It emboldens offenders and makes real children less safe. These new laws are a critical step, but further action is needed to prevent AI misuse in this manner."
Lynn Perry, CEO of children's charity Barnardo’s, praised the government’s crackdown and urged tech companies to take stronger action: "Legislation must keep pace with AI advancements to prevent online exploitation. Companies must introduce better safeguards, and regulatory bodies like Ofcom must ensure strict enforcement of online safety laws."
These new measures will be introduced as part of the Crime and Policing Bill, set to be presented in Parliament in the coming weeks.
